Fisk has a comprehensive policy prohibiting 性ual misconduct. 这项政策适用于学生, 教师, 工作人员, contractors and visitors in their interactions with students. Individuals do not need to determine whether or not an incident constitutes an act of 性ual misconduct in order to report it.

“Sexual 不当行为” includes all forms of 性 or gender-based misconduct, 骚扰, 性暴力, 性剥削, /家庭/约会暴力的关系, 和被人跟踪.  A number of acts are encompassed within the definition of Sexual 不当行为 including rape, 性电池, 性虐待, 以及性胁迫.  All acts of Sexual 不当行为 are strictly prohibited at Fisk University.

Consent may not be inferred from silence, passivity, or the lack of active resistance, alone.  Non-consensual 性ual activity 和/或 contact is Prohibited Conduct.

Consent is not present in the following circumstances:

(i)          When one of the parties is not voluntarily engaging in an activity or is coerced, 比如通过使用武力, 肉体或精神伤害的威胁, 过度的压力, 隔离, 或监禁;

(ii)         When a person is Incapacitated (Defined further below);

(iii)当一个人在睡觉时 , unconscious or otherwise unable to communicate an unwillingness to engage in an activity; or

(iv)        A person lacks the ability to make or understand the decision because they suffer from a mental disease or defect that renders them incapable of appraising the nature of the activity;

A current or previous dating or 性ual relationship is not sufficient to constitute Consent, and Consent to one form of 性ual activity does not imply consent to other forms of 性ual activity.

The perspective of a reasonable person will be the basis for determining whether a Respondent knew, 或者理应知道, whether a Complainant was able to 自由 give Consent and whether Consent was given.

请注意，根据本政策, being intoxicated or incapacitated does not diminish one’s responsibility to obtain Consent and will not be an excuse for Prohibited Conduct

Fisk encourages all members of the University community to report violations of this policy to: 米奇西, 第九条协调员. Reports involving Sexual 不当行为 may be made at any time. A report involving Sexual 不当行为 may be made confidentially to those who serve in a professional role in which communications are privileged under Tennessee law and to those which Fisk has designated as confidential reporters consistent with 第九条. Those persons are: Medical Providers, Therapists, and Clergy. 学生们应该意识到, 除了这些机密资源, all employees who become aware of conduct that might fall under this policy are expected to notify the 第九条协调员 with the names of the parties involved and the details of the report. Students who serve in an ongoing peer-advising role (such as Resident Assistants) are also expected to share such reports with the Office of Student Conduct.
